Aquando da sua revis\u00e3o, gerou-se muita expectativa sobre as inova\u00e7\u00f5es que seriam introduzidas neste novo instrumento de regulamenta\u00e7\u00e3o das rela\u00e7\u00f5es laborais. E muitas dessas expectativas foram satisfeitas.<\/p><p>Para al\u00e9m de conceitos novos, da introdu\u00e7\u00e3o do gloss\u00e1rio, da adi\u00e7\u00e3o das modalidades de trabalho intermitente e teletrabalho, do alargamento do prazo das licen\u00e7as de maternidade e paternidade, do aprofundamento de determinadas mat\u00e9rias, bem como da correc\u00e7\u00e3o de algumas insufici\u00eancias da vers\u00e3o anterior, <strong>a nova Lei de Trabalho pretende trazer mais justi\u00e7a \u00e0s rela\u00e7\u00f5es laborais.<\/strong><\/p><p>Todavia, <strong>numa an\u00e1lise mais minuciosa<\/strong> deste novo instrumento de regulamenta\u00e7\u00e3o das rela\u00e7\u00f5es laborais, <strong>v\u00e1rios erros, que carecem, no meu entendimento, da produ\u00e7\u00e3o de uma errata, foram identificados.<\/strong> Falo de i) erros de digita\u00e7\u00e3o \u2013 <em>typos<\/em>. Por exemplo, no artigo 25, n\u00famero 1, al\u00ednea c) e no artigo 112, n\u00famero 3, al\u00edneas b) e c); e, ii) erros de remiss\u00e3o a artigos errados ou inexistentes, como \u00e9 o caso dos artigos 43, 87, 162 (n\u00famero \u00fanico) e 161, n\u00fameros 6, 3 e 1, respectivamente.<\/p><p>Para efeitos deste artigo, <strong>gostava de me focar em tr\u00eas erros graves que, no meu entendimento,<\/strong> <strong>precisam de ser sanados<\/strong> para que n\u00e3o fiquem \u00e0 merc\u00ea da melhor, ou mais conveniente, interpreta\u00e7\u00e3o do empregador ou do colaborador, que sabemos que s\u00e3o quase sempre divergentes.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-96351c2 elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"96351c2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t\"...erros de digita\u00e7\u00e3o - typos. ...erros de remiss\u00e3o a artigos errados ou inexistentes...\"\t\t\t<\/p>\n\t\t\t\t\t\t\t<div class=\"e-q-footer\">\n\t\t\t\t\t\t\t\t\t\t\t<cite class=\"elementor-blockquote__author\">Vicente Sitoe<\/cite>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7d3ae57 elementor-widget elementor-widget-text-editor\" data-id=\"7d3ae57\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Primeiro, sobre o Procedimento Disciplinar: Artigo 72, n\u00famero 1, al\u00ednea c)<\/strong><\/p><p>A nova lei permite a interpreta\u00e7\u00e3o de que sempre que o trabalhador deixar caducar o prazo de resposta \u00e0 Nota de Culpa, todo o processo disciplinar torna-se inv\u00e1lido. Ora, a ser assim, a pr\u00f3pria lei estar\u00e1 a ser amb\u00edgua porque a resposta \u00e0 Nota de Culpa \u00e9 facultativa para o trabalhador (artigo 70, n\u00famero 1, al\u00ednea b). A permanecer como est\u00e1, aproveitamentos indevidos deste erro ser\u00e3o feitos at\u00e9, como \u00e9 \u00f3bvio, decis\u00e3o do Juiz ou \u00c1rbitro, que ser\u00e1 tomada por bom senso e n\u00e3o numa base emp\u00edrica.<\/p><p><strong>Segundo, sobre a Caducidade do Contrato a Prazo Incerto: Artigos 46 e 141, n\u00fameros 7 e 5, respectivamente<\/strong><\/p><p>Estes dois artigos introduzem dois regimes indemnizat\u00f3rios diferentes no caso de rescis\u00e3o de contrato sem justa causa do contrato a prazo incerto. Se, no primeiro artigo, \u00e9 conferido um direito de indemniza\u00e7\u00e3o correspondente a 45 dias por cada ano de servi\u00e7o, no segundo artigo \u00e9 introduzida uma outra f\u00f3rmula de c\u00e1lculo do valor da indemniza\u00e7\u00e3o, em fun\u00e7\u00e3o da equipara\u00e7\u00e3o do sal\u00e1rio do trabalhador ao sal\u00e1rio m\u00ednimo do sector.<\/p><p><strong>Terceiro, sobre as licen\u00e7as de maternidade e paternidade: Artigos 14 e 15<\/strong><\/p><p>Enquanto no artigo 14, o n\u00famero 5 \u00e9 claro sobre a entidade respons\u00e1vel pela remunera\u00e7\u00e3o da trabalhadora que esteja em licen\u00e7a de maternidade, no artigo 15, que versa sobre a licen\u00e7a de paternidade, essa clareza \u00e9 inexistente. Com isto, fica o entendimento de que a trabalhadora em licen\u00e7a de maternidade tem a sua remunera\u00e7\u00e3o proveniente da seguran\u00e7a social obrigat\u00f3ria, enquanto o trabalhador em licen\u00e7a de paternidade, seja de 7 ou 60 dias, tem a sua remunera\u00e7\u00e3o a ser paga pelo empregador.<\/p><p>Ora, esta situa\u00e7\u00e3o \u00e9 promotora de uma grave iniquidade de g\u00e9nero. Pois, dada a morosidade processual na seguran\u00e7a social, aliada ao desconhecimento dos procedimentos por parte de alguns contribuintes, no geral, e \u00e0s \u201cfaltas de sistema\u201d, a remunera\u00e7\u00e3o das trabalhadoras pode (e costuma) levar mais tempo a ser processada do que o desejado.
